TERMS OF ENTRY

 

The following terms and conditions apply exclusively to the aforementioned competition and all participants in the competition are deemed to have read, understood and accepted the same.

 

Eligibility

1. The Competition will run from 00:00 GMT March 10th 2020 to 17:00 GMT March 17th 2020 and is open to all residents in the UK, except employees of OPPO Mobile UK Co. Ltd (“The Organizer”/ “we”).
2. All participants must be aged 18 years or older at the date of entry and will be required to exhibit proof of age prior to redemption of any prize.

 

Participation Criteria

To enter, participants will need to go to Post an image on their own Instagram accounts with image relating to Mother’s day, then tag OPPO Mobile UK’s Instagram account (@oppomobileUK) and #mothersdaywithOPPO on their post. Participants will need to have their account on public, so OPPO UK can see the participants post to select winner.
3. There is 1x OPPO watch Pink Gold to give away in total.
4. Prize fulfilment will be organised by OPPO UK.
5. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.
6. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
7. The winner will be selected at random from the pool of entrants who posted an image on their own accounts and tagged @oppomobileuk on Instagram and #mothersdaywithOPPO on their post. This selection will be carried out by The Organiser and its affiliates according to the participation criteria. The judging panel’s decision is final and no discussion will be entered into.
8. The winners shall be selected by the Organizer, only if they have met the Participation Criteria above.

10. The Organizer and its affiliates will not be responsible for any expenses and losses which the winner may incur as a result of their acceptance and/or use of a prize except as expressly stated in these Terms and Conditions, whether foreseen or not.
11. The winner will be required to message their contact details to @oppomobileuk on the same day the winner is announced, by replying to a private message on Instagram. It is the participant’s responsibility to ensure that the contact details they provide are complete, accurate and up to date. We shall call or email the winner and advise them on how to access their prize.

General Terms

 

1. Subject to applicable law, the participants absolve The Organizer against any damages that anyone may suffer as a result of the prize or this competition, including but not limited to consequential and economic loss.
2. The Organizer and its affiliates will not be responsible for difficulties experienced in submitting an entry to this competition. Any technical failure or malfunction, including but not limited to any affecting upload submissions due to poor connection speeds, which may result in any entry being lost or not properly registered or recorded.
3. The prize is not transferable and may not be deferred, changed or exchanged for cash or any other item.
4. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
5. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Entrants understand that they are providing their information to the Promoter and not to Facebook or Instagram. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook or Instagram.
6. All entrants unconditionally and irrevocably release and discharge Facebook from any and all liability in relation to this Promotion.
7. OPPO and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.

IPR

 

1. The Organizer shall have the right to use the photos of any participants in any way, including but not limited to the Organizer’s media and third party’s media in perpetuity.

 

Use of Personal Data

 

1. By participating in the competition, the winner of the prize agrees that their full name, photos, video footage and other details be made public in such media that The Organizer may choose and that they will further agree to participate in all public relations and marketing activities of which The Organizer may require, as The Organizer may require without any additional consideration.
2. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
3. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
4. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent.
5. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages.
6. By entering this competition, entrants agree to be added to the OPPO databases to receive communications from OPPO and their partners. All entries become the property of The Promoter. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
7. OPPO is collecting the entrant's personal information for the purpose of conducting and promoting this competition (including but not limited to determining the winner). If you are not willing for this to occur you cannot participate in the Promotion.
8. Entrants’ personal information may be disclosed to lottery departments and winners’ names published as required under the relevant lottery legislation. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter.

 

Disqualification and Termination

 

1. The Organizer reserves the right to amend or vary these Terms and Conditions or to suspend/amend/terminate the promotion at any time.
2. The Organizer has the right to refuse to award the prize if they deem necessary for any reason.
3. Neither The Organizer and their affiliates nor their respective advertising, media and PR agencies, nor their trading partners shall be liable in any way whatsoever for any personal injury, loss, damage or costs, howsoever arising, suffered by an entrant to this competition and/or participant in the prize offered, including any tax liability.
4. Nothing contained in these Terms and Conditions shall be construed as conferring any license or right to use any trade mark, design right, copyright or any other intellectual property right of the Organizer or any other third party.

6. Participants will not be required to send money, airtime or mobile money funds or any other consideration in order to participate or claim any prize in this competition. The Organizer shall not be liable for any losses or other damage incurred by any person who does not heed this caution.
7. Participants agree that any condition, warranty, representation or other term concerning aforesaid competition and prize which might otherwise be implied into or incorporated in these Terms and Conditions, is excluded to the maximum extent permitted by law.
8. These Terms and Conditions will be governed by the laws and be subject to the exclusive jurisdiction of the courts of the United Kingdom.
9. The Organiser acknowledges that this promotion is in no way sponsored, endorsed, administered by or associated with Facebook, or other social media platforms, and these platforms hold no responsibility for the management or outcome thereof.
10. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
11. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
