This page (together with any documents made reference to) states the terms of use on which you may make use of our website www.oppostore.co.uk ("OPPO Store") and product ordering and other services we offer ("service" or “services”), whether as a guest or a registered OPPO Store user. Please ensure to read these terms of use carefully before you begin to use the OPPO Store and/or the services. By using the OPPO Store and/or our services, you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please do not use the OPPO Store and/or the services.

1 | Information about Five Tech

The Website www.oppostore.co.uk is operated by Five Tech ("we", "us", "our"). Our registered office is Unit 10 Woodford Trading Estate, Southend Road, Woodford Green, Essex, IG8 8HF, registered in England & Wales Company No. 07267226.

2 | Accessing the OPPO Store

2.1. Access to the OPPO Store is simple to navigate through, and we reserve the right to withdraw or amend the services we provide via the OPPO Store or the Website itself without notice. We will not be liable to you if for any reason the OPPO Store or the services are temporarily unavailable at any time or for any period.

2.2. From time to time, we may restrict access to some or all parts of the OPPO Store and/or the services, e.g. maintenance purposes or for Website updates.

2.3. The User of the OPPO Store can make a purchase as a Guest or as an OPPO registered member. If you are not an OPPO registered member, users can simply Sign-up during the checkout process.

2.4. Age Restriction: The checkout must only be completed by or on behalf of individuals who can form legally binding contracts under applicable laws, who are at least 16 years of age and who are not barred from using the Web Site under applicable laws.

2.5. The User is responsible for making all arrangements necessary to have access to the OPPO Store and/or our services.

3 | Use of the OPPO Store

3.1. To order products from the OPPO Store please follow the instructions on screen.

3.2. You may not use the OPPO Store or its contents:

i. For commercial purposes;

ii. For resale purposes/ taking parts or contents from the OPPO Store (e.g. item listings, descriptions, prices);

iii. To download (other than page caching) or modify the OPPO Store;

iv. For any purpose which is prohibited.

4 | Intellectual Property Rights

4.1. We are an OPPO-authorised independent reseller and have the intellectual property rights in the OPPO Store including the services and any published material. Those works are protected by copyright, trade mark, database rights and other such intellectual property laws and treaties around the world. All such rights are reserved.

4.2. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

4.3. If you print, copy or download any part of the OPPO Store in breach of these terms of use, your right to use the OPPO Store will cease immediately and you must return or destroy any copies of the materials you have made.

4.4. Using the OPPO Store does not give you permission to link to it or to use any of the trade marks, designs and/or logos contained within it.

4.5. OPPO Store and all logos on the Website are business names and marks which are the property of Five Tech or OPPO.

5 | Regular Changes on the OPPO Store

We aim to update the OPPO Store and maintain the services regularly, which may involve changing the content at any time. If the need arises out of our control, we may suspend access to the OPPO Store or the services, or close it indefinitely. Any of the material on the OPPO Store may be outdated at any given time, and we are under no obligation to update such material.

6 | Our Liability

6.1. Whilst we have taken every care in the preparation of the content of the OPPO Store we cannot guarantee that it is accurate or error-free. We will not be responsible for any errors, omissions or for any technical difficulties you may experience with the OPPO Store. Except as set out in this condition, all conditions, warranties and representations, expressed or implied by statute, common law or otherwise, in relation to the supply, non-supply or delay in supplying the services are excluded to the extent permitted by law.

6.2. We shall not be liable to any person for any loss or damage which may arise from the use or misuse of the OPPO Store or any of the materials on the OPPO Store (including loss of revenue, profits, contracts, anticipated savings, wasted expenditure, data or goodwill). Nothing in these terms of use shall operate to exclude or restrict our liability for:

i. Death or personal injury resulting from negligence;

ii. Fraud or deceit; or

iii. For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

7 | User Submissions

We do not accept and will not consider unsolicited submissions of ideas, creative materials, processes, comments, feedback or technology. Please note that any Unsolicited Submissions sent to us will be deemed NOT to be confidential. By sending us any Unsolicited Submissions, you grant us an unrestricted, irrevocable, perpetual, non-exclusive, royalty-free, , fully transferable, reproduce, display, perform, modify, transmit and distribute those Unsolicited Submissions for any purpose whatsoever. You hereby acknowledge that you grant us such rights in consideration of the right to access and utilize under no obligation to further compensate you or acknowledge your submission. By participating in OPPO x Wimbledon survey you automatically consent to be added in our OPPO members club

  • i. Referrers will receive a one-time £15 off promotional discount for each Qualified Referral. A Qualified Referral is defined as a first purchase made at www.oppostore.co.uk by a person (a "Referred Customer") who arrives to our website by clicking on the unique Refer-a-Friend program link.
  • ii. As a Referrer, you are limited to one Qualified Referral for each Referred Customer; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals.
  • iii. The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address). The Referred Customer must complete an order on OPPO Store  and must have not shopped on www.oppostore.co.uk before to earn Referral Rewards.
  • iv. For each Qualified Referral, the Referred Customer will receive a one-time £10 discount off his/her first purchase at www.oppostore.co.uk.
  • v. Referral Discounts are not redeemable for cash, gift cards or e-gift cards, and cannot be used on previous purchases.
  • vi. Referral Discounts are not valid on tax or shipping and cannot be combined with other offers or promotions.
  • vii. Referral Discounts may only be redeemed for purchases made in UK.
  • viii. OPPO reserves the right to close the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the OPPO Refer-a-Friend program in a questionable manner or breaches any of these Terms & Conditions or is in violation of any law, statute, or governmental regulation.
  • ix. OPPO reserves the right to cancel the Refer-a-Friend Program or to change these Terms & Conditions at any time in its sole discretion. Any unclaimed Referral Credits will be forfeited at that time.

8 | Using the OPPO Store

We process information about you in accordance with our Privacy Policy. By using the OPPO Store and/or our services, you consent to such processing of your personal data and you warrant that all data provided by you is accurate.

9 | Links from the OPPO Store

Where the OPPO Store contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss/ damage that may arise from your use of them.

10 | Accounts

10.1. If you choose to create an account you represent and warrant to us that all information you provide to us is true, accurate, current and complete. If we believe or suspect that such information is untrue, inaccurate, not current, or incomplete, we may deny or terminate your access to the OPPO Store. You may not transfer or share your username and password with any third parties. You are solely responsible for maintaining the confidentiality of your Account log-in information, including but not limited to taking steps to prevent unauthorized access by safeguarding your log-in information. You are solely responsible for any and all use of your Account and all activities that occur through your Account.

10.2 In line with our privacy policy account details are shared with OPPO UK Mobiles Ltd for legitimate reasons for the purpose of analysis, marketing, quality assurance.

10.3 On creation of an account, you may opt in to receive marketing information or promotions related to OPPO. In line with our privacy policy, your information is shared with OPPO UK Mobile Ltd for the purpose of marketing. You consent that OPPO UK Mobile Ltd is allowed access to your data for the purpose of marketing. OPPO Mobile UK Ltd may use agencies to fulfil activities related to marketing.

11 | Electronic Communication

Communication between you and us via the OPPO Store or email uses electronic means. You consent to receive communication from us in an electronic form; and agree to all terms and conditions, notices, disclosures and other communication we provide to you electronically. Which satisfy any legal requirement that such communications would satisfy if it were in a writing.

12 | Waiver

If you breach these terms of use and we take no action we will still be entitled to use our rights and remedies at a later date or in other situations where you are in breach.

13 | Alterations to these Terms of Use

We may revise these terms of use at any time by modifying this page. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on the OPPO Store.

14 | Jurisdiction and Applicable Law

These terms of use (and any dispute, controversy, proceedings or claim of whatever nature arising out of or in any way relating to these terms of use or their formation) will be governed by and construed in accordance with the laws of England and Wales. You agree to submit to the non-exclusive jurisdiction of the English courts, as do we, regarding any dispute arising from, or related to, these terms of use or related contract.

1- The promoter is: OPPO MOBILE UK Ltd whose registered office is at 258 BATH ROAD, SLOUGH, ENGLAND, SL1 4DX.

2- The competition is open to residents of the United Kingdom aged 18 years or over except employees of OPPO MOBILE UK and their close relatives and anyone otherwise connected with the organisation or judging of the competition.

3- There is no entry fee and no purchase necessary to enter this competition.

4- By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions. So please read them carefully before you participate in the competition and keep a copy for your records.

5- Route to entry for the competition and details of how to enter are via OPPO Store (www.oppostore.co.uk) site.

6- The rules of the competition and how to enter are as follows: To be entered in the competition, Entrants need to Pre-register on OPPO Store site with the Find X5 series between 24th Feb – 9th March 2022. Then pre-order the Find X5 or Find X5 Pro between 10th March – 24th March with any channel.

14- The winner will be notified by email within 2 days of the finalising date. If the winner cannot be contacted or do not claim the prize within 4 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

9- Purchases from auction websites (e.g. eBay) or from third party sellers or online retailers’ websites (e.g. Amazon Marketplace) or any other retailer that is not listed above in Table 1, are specifically excluded from this Promotion.

10- Gift with Purchase items are non-transferable or exchangeable and there is no cash alternative. In the event of unforeseen circumstances, the Promoter may substitute a Gift with Purchase item of equal or greater value for the Gift with Purchase item. Where a Gift with Purchase item is offered in a choice of colours, the Promoter reserves the right to provide an alternate colour option if required.

Claims

11- To claim, Participants must purchase a Promotional Product during the Pre-Order Period then visit www.OPPOClaim.co.uk and complete the online claim Form (a “Claim”) by completing the following steps:

  • Upload a valid Proof of Pre-order (receipt, copy of email confirmation) and a valid Proof of Purchase (receipt, order confirmation, order confirmation email, delivery note)
  • Enter the date of Pre-Order.
  • Enter their personal details (name, address, mobile number, email address)
  • Enter the IMEI number of the new phone (in the case of dual SIM models, only IMEI No1 should be submitted)

12- Maximum one (1) Claim per eligible product. Maximum four (4) claims per household. Maximum one hundred (100) claims per business customer.

13- Participants will be sent an email to the email address used when making their Claim, immediately after submitting their Claim to confirm that their Claim has been received by the Promoter. If an email acknowledgement has not been received, it is the Participant’s responsibility, have checked the junk/spam folder of the email inbox, to contact the Promoter’s customer service team using the email address [email protected] within seven (7) days of a Claim being submitted. In the event that a Participant does not inform the Promoter within this time frame, the Promoter will reserve the right to not issue the Gift with Purchase item or limit its value at their sole discretion.

14- Claim Validation will take up to 28 days.
Once the claim has been validated and the Retailer has confirmed that the Promotional Product has not been returned, an email will be sent to the Participant advising that the Claim has been approved and the Gift with Purchase item will be dispatched within 28 days. (‘Claim Validation.’)

15- If a Claim is deemed to have been submitted incorrectly, the Participant will be notified via email and offered the Opportunity to provide the required information within seven (7) days of submission. If no response is received within seven (7) days of the email, then the Claim shall be marked as invalid and the Participant will no longer be eligible to receive the Gift with Purchase item.

16- Claims that are incomplete, illegible, or damaged together with Claims which do not satisfy the requirements of these Terms and Conditions will be deemed invalid.

17- The Gift with Purchase item will be delivered within twenty eight (28) days of the Claim being validated and will only be sent to a valid address in the UK, Isle of Man or Channel Islands postal address that is provided during the Claim.

18- The Promoter reserves the right, at its absolute discretion, to disqualify Claims which it considers do not comply with these Terms and Conditions.

19- The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid Claims including, without limitation, to require further verification as to proof of purchase, as well as the identity, age and other relevant details of a Participant. The Promoter may refuse to award a Gift with Purchase item in the event of any Participant’s fraud, dishonesty, breach, or non-entitlement under these Terms & Conditions or seek recovery of its value if the Gift with Purchase item has been awarded.

20- This Promotion may not be combined with any other promotion offered by the Promoter.

Privacy and Data Protection

21- The Promoter’s use of any personal information submitted by the Participant shall be limited to communications about the Promotion and future Promotional Activity operated by the Promoter. The Participant hereby consents to its personal information being used for this purpose and confirms that it agrees with the Promoter’s privacy policy available at: www.OPPO.com/en/privacy/ .

22- Participants’ data shall not be passed to any third party other than for the purposes of administering this promotion.

General

23- The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter’s control. Should an act, omission, event or circumstance occur which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms & Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligations.

24- In the event that the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and to cancel, modify or suspend the Promotion or invalidate any affected entries.

25- The Promoter will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or Claims; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Promotion.

26- Participants will be solely responsible for any and all applicable taxes and any other relevant costs or expenses which are not stated in the Terms and Conditions as being included.

27- The Promoter together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a Gift with Purchase item except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.

28- If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this will not affect or impact the continuation in full force and effect the remainder of the provisions.

29- These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.

The Promoter

Purchase Period

2- The Purchase Period will commence at 00:01 (UK) on 24th March 2022 and will close at 23:59 (UK) on 13th April 2022 (‘Purchase Period’). March 2022 and will close at 23:59 (UK) on 23rd March 2022 (‘Pre-Order Period’).
Purchase and a valid email address are necessary.
This Promotion is subject to the standard sale Terms and Conditions of the participating retailers that cover the deposit and purchase of the Promotional Product.

Claim Period

3- The Claim Form found at www.OPPOClaim.co.uk will be open for claims from 00:01 (UK) on 24th March 2022 and will close at 23:59 (UK) on 11th May 2022 (‘Claim Period’).

Eligibility

4- To be eligible to participate in the Promotion you must be an individual that is a resident (aged 18 or over) in the United Kingdom, Isle of Man or Channel Islands (“Participant”).

5- Employees or agents of the Promoter that are involved in the operation of this Promotion or anyone professionally connected to this Promotion are not eligible to enter.

6- Network providers, retailers, distributors, resellers and any person who purchases a Promotional Product (defined in Condition 5) for resale or otherwise not as the user of the Promotional Product, may not participate in this Promotion and are specifically excluded as a Participant.

7- This Promotion is not available in conjunction with any other OPPO offer or Gift with Purchase promotion.

Offer

8- Participants who Pre-Order a new (i.e. not second hand, refurbished. ex-display or damaged box) OPPO FIND X5 Lite promotional product (“Promotional Product”) from a Participating Retailer as defined in Table 1 below (“Participating Retailer”) in the UK, Isle of Man or Channel Islands (the “Territories”) either online, in-store or via telesales within the Purchase Period, and whom complete their order with the retailer, will be eligible to claim the associated Gift with Purchase as shown in Table 2 below (“Gift with Purchase”) by redemption, subject to full compliance with the Terms and Conditions.

9- Purchases from auction websites (e.g. eBay) or from third party sellers or online retailers’ websites (e.g. Amazon Marketplace) or any other retailer that is not listed above in Table 1, are specifically excluded from this Promotion.

10- Gift with Purchase items are non-transferable or exchangeable and there is no cash alternative. In the event of unforeseen circumstances, the Promoter may substitute a Gift with Purchase item of equal or greater value for the Gift with Purchase item. Where a Gift with Purchase item is offered in a choice of colours, the Promoter reserves the right to provide an alternate colour option if required.

Claims

11- To claim, Participants must purchase a Promotional Product during the Purchase Period then visit www.OPPOClaim.co.uk and complete the online claim Form (a “Claim”) by completing the following steps:

  • Upload a valid Proof of Purchase (receipt, order confirmation, order confirmation email, delivery note)
  • Enter the date of purchase.
  • Enter their personal details (name, address, mobile number, email address)
  • Enter the IMEI number of the new phone (in the case of dual SIM models, only IMEI No1 should be submitted)

12- Maximum one (1) Claim per eligible product. Maximum four (4) claims per household. Maximum one hundred (100) claims per business customer.

13- Participants will be sent an email to the email address used when making their Claim, immediately after submitting their Claim to confirm that their Claim has been received by the Promoter. If an email acknowledgement has not been received, it is the Participant’s responsibility, have checked the junk/spam folder of the email inbox, to contact the Promoter’s customer service team using the email address [email protected] within seven (7) days of a Claim being submitted. In the event that a Participant does not inform the Promoter within this time frame, the Promoter will reserve the right to not issue the Gift with Purchase item or limit its value at their sole discretion.

14- Claim Validation will take up to 28 days.
Once the claim has been validated and the Retailer has confirmed that the Promotional Product has not been returned, an email will be sent to the Participant advising that the Claim has been approved and the Gift with Purchase item will be dispatched within 28 days. (‘Claim Validation.’)

15- If a Claim is deemed to have been submitted incorrectly, the Participant will be notified via email and offered the Opportunity to provide the required information within seven (7) days of submission. If no response is received within seven (7) days of the email, then the Claim shall be marked as invalid and the Participant will no longer be eligible to receive the Gift with Purchase item.

16- Claims that are incomplete, illegible, or damaged together with Claims which do not satisfy the requirements of these Terms and Conditions will be deemed invalid.

17- The Gift with Purchase item will be delivered within twenty eight (28) days of the Claim being validated and will only be sent to a valid address in the UK, Isle of Man or Channel Islands postal address that is provided during the Claim.

18- The Promoter reserves the right, at its absolute discretion, to disqualify Claims which it considers do not comply with these Terms and Conditions.

19- The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid Claims including, without limitation, to require further verification as to proof of purchase, as well as the identity, age and other relevant details of a Participant. The Promoter may refuse to award a Gift with Purchase item in the event of any Participant’s fraud, dishonesty, breach, or non-entitlement under these Terms & Conditions or seek recovery of its value if the Gift with Purchase item has been awarded.

20- This Promotion may not be combined with any other promotion offered by the Promoter.

Privacy and Data Protection

21- The Promoter’s use of any personal information submitted by the Participant shall be limited to communications about the Promotion and future Promotional Activity operated by the Promoter. The Participant hereby consents to its personal information being used for this purpose and confirms that it agrees with the Promoter’s privacy policy available at: www.OPPO.com/en/privacy/ .

22- Participants’ data shall not be passed to any third party other than for the purposes of administering this promotion.

General

23- The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter’s control. Should an act, omission, event or circumstance occur which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms & Conditions the Promoter will not be liable for any failure to perform or delay in performing its obligations.

24- In the event that the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions and to cancel, modify or suspend the Promotion or invalidate any affected entries.

25- The Promoter will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or Claims; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Promotion.

26- Participants will be solely responsible for any and all applicable taxes and any other relevant costs or expenses which are not stated in the Terms and Conditions as being included.

27- The Promoter together with any associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using a Gift with Purchase item except for any liability which cannot be excluded by law. Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.

28- If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this will not affect or impact the continuation in full force and effect the remainder of the provisions.

29- These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.
